Nuvaring Lawsuit

NuvaRing (desogestrel) is a small flexible hormone producing ring that is inserted vaginally as a birth control option for women. The ring is left in the vagina for 3 weeks and allows for a continuous release of low dose hormones. NuvaRing is a third generation contraceptive containing a hormone called desogestrel that is manufactured by Merck. Some researchers say desogestrel containing contraceptives raise the risk of blood clot without adding any benefit over older contraceptives.

Recently, medical news has discovered that NuvaRing has started causing some problems in women who were previously completely healthy. The side effects that are being linked to NuvaRing’s use are blood clots that can be deadly, as they lead to fatal conditions such as pulmonary embolisms, heart attacks and strokes. iStock_000010501389XSmall

In 2007, consumer watchdog group Public Citizen petitioned that the FDA ban desogestrel containing contraceptives. NuvaRing was not specifically named in this petition because the drug was very new at the time. Dr. Sidney Wolfe of Public Citizen’s Health Resource Group concluded that, “we’ve told people not to use these drugs and have advised women that the safest contraceptives are the older, second generation ones.” The FDA never acted on Public Citizen’s claims, but did state that NuvaRing’s label should “clearly reflect safety concerns about increased risk” for blood clots. To date, nearly 1,000 cases of possible NuvaRing induced blood clots have been reported to the FDA, and Merck is being sued by more than 700 women for downplaying the drug’s health risks.

In 2009, the British Medical Journal published two investigations regarding safety of desogestrel and fourth-generation progestins. Both studies have found that patients taking third and fourth-generation pills are almost twice as likely to suffer a blood clot when compared with those who took second generation contraceptives.

Currently, all NuvaRing lawsuit settlements begin in multi district litigation, meaning all of the preliminary parts and discoveries relating to the case will be held in one court. This provides the court with all necessary information needed for background of all lawsuits being filed. There is no class action suit filed against NuvaRing at this time.
