Dangerous Medicines and Medical Products
Whether it is a prescription drug or defective implant, dangerous medical products can cause a patient great harm. Meant to help, they cause more harm and can leave patients with lasting pain and injuries. If you have been affected by one of these products, it is important that you seek legal counsel to protect your rights. Our firm handles many different types of cases involving defective medicines and medical products such as:
Accutane:
Accutane (isotretinoin) was approved by the FDA in the 1980’s for treatment of severe acne. Accutane is a very strongdrug and research shows that people taking it have an increased risk of developing Irritable Bowel Syndrome (IBS). There have been reported cases of people taking Accutane who have developed IBS. Irritable Bowel Syndrome is a disorder in the lower intestinal tract. People with IBS may have abdominal pain, bloating, distention, diarrhea, constipation, mental or emotional distress, depression and loss of appetite. If you or a loved one has taken Accutane and developed Irritable Bowel Syndrome, contact our office for a free case evaluation.
New reports have indicated that the diabetes drug ACTOS may also increase the chances of developing bladder cancer, with some sample sizing showing as much as a 40% increase. The drug has already been pulled from the market in several European countries. The Law firm of Rudolph F.X. Migliore, P.C. is investigating ACTOS cases in the United States. DePuy Orthopaedics - Defective Hip Replacements:
DePuy Orthopaedics issued a worldwide recall of its ASRTM XL Acetabular System and DePuy ASRTM Hip Resurfacing System used in hip replacement surgery due to the number of patients who required a revision surgery. Complaints to the Food and Drug Administration and DePuy studies showing that some patients experienced pain, swelling and mobility issues have led to revision surgery. The revision surgery rate for the DePuy products is twice the industry average.

Fosamax:
Fosamax is a bisphosphate drug used to treat and prevent osteoporosis in post-menopausal women, steroid-induced osteoporosis in men and other bone diseases. Investigation into Fosamax-related femur fractures has determined that patients who have taken Fosamax face significant risk of a spontaneous femur fracture. These atypical hip/thigh fractures occur in minor or "low impact" falls from a standing height or less, rather than a traumatic accident or injury.
The FDA and other independent research studies indicate that femur fracture patients have reported experiencing severe pain of the joints, muscles and/or bones for periods of weeks to months before a complete fracture occurred. Rudolph Migliore explains "a fractured hip is a serious injury and a significant impairment, particularly as we age. Having a hip fracture as a result of medication can happen at an inordinately young age in people whose doctors prescribed Fosamax”.
Extensive product liability experience gives attorney Rudolph F.X. Migliore the expertise necessary to handle complicated defective prescription drug cases. The Migliore law firm has represented clients in wide range of defective product and drug cases since 1977 and has worked with nationally recognized co-counsel to reach successful settlements for clients.

Recently, medical news has discovered that NuvaRing has started causing some problems in women who were previously completely healthy. The side effects that are being linked to NuvaRing’s use are blood clots that can be deadly, as they lead to fatal conditions such as pulmonary embolisms, heart attacks and strokes.
Recently, studies have shown that patients on Pradaxa have a 33% higher risk of heart attack when compared to previously prescribed medications. The FDA is currently investigating an unusually high number of reports of serious bleeding linked to Pradaxa’s use.
Yaz, Yazmin, Ocella:
Yaz, Yasmin and Ocella contain a progestin hormone called drospirenone, that have been linked to increased incidence of deep venous thrombosis (DVT), pulmonary embolism (PE), and gallbladder problems. Lawsuits have been filed against Bayer (the maker of Yaz and Yasmin), claiming serious and potentially fatal side effects of Yaz and Yasmin. Bayer Healthcare Pharmaceuticals faces lawsuits alleging that these products can cause potentially fatal blood clots and/or gallbladder disease. There are currently more than 10,538 Yaz and Yasmin injury lawsuits filed in Federal District Courts throughout the United States. All of the cases involve allegations that Bayer failed to adequately warn patients of the risk of serious, potentially life-threatening side effects of Yaz and Yasmin birth control. There are a series of three trials, known as bellwether cases, expected to begin in 2012.
